XOXOdrama Terms of Service

1. Who We Are and Acceptance of These Terms

1.1 These Terms of Service ("Terms") are an agreement between you and XOXO Drama Media s.r.o., a limited liability company incorporated in the Czech Republic, with its registered office at U Průhonu 800, 170 00 Praha 7-Holešovice, Czech Republic, Company ID (IČO) 29354379, registered in the Commercial Register maintained by the Municipal Court in Prague (Městský soud v Praze), file no. Section C, Insert 617284 ("XOXO Drama Media," "we," "us" or "our"). These Terms govern your access to and use of the XOXOdrama website at https://xoxodrama.com and its related features and services (the "Service").

1.2 You accept these Terms when you (a) confirm on our age confirmation screen that you meet the requirements in Section 2 and select "Enter," (b) create or sign in to an account, or (c) otherwise access or use the Service. A link to these Terms and to our Privacy Policy is shown before you take any of these steps. If you do not agree to these Terms, do not use the Service.

1.3 Our Content Standards, Underage Policy, AI Disclosure, Copyright Policy and Reporting and Removal Policy, each available on the Service, form part of these Terms. Our Privacy Policy and Cookie Policy explain how we handle personal information.

1.4 Language. These Terms are provided in English. Mandatory local language and consumer protection requirements continue to apply. Where a local-language version is legally required, we will provide it before asking a consumer to be bound; if that requirement cannot be met, we do not offer the Service in that location. No translation or choice of English waives a mandatory local right.

2. Eligibility, Age and Location

2.1 Age. You must be at least 18 years old and have reached the higher minimum age, if any, required for adult content where you are located. The Service is not directed to anyone below that age. The applicable threshold may differ between countries, states and provinces.

2.2 Age assurance. We ask you to confirm that you meet the age requirement. This is a self-declaration, not verification of identity or age. Giving false information breaches these Terms. We may ask for confirmation again. We do not offer access in a location where the required level of age assurance is not supported by the Service. A different verification process, if introduced, will be explained before it collects information.

2.3 Legality where you are. You may use the Service only if viewing sexually explicit material is legal for you where you are located. You are responsible for complying with the laws that apply to you, and you confirm that no applicable law prohibits you from receiving the Service.

2.4 Available locations. The Service is operated from the Czech Republic for adults in locations in which it is lawfully offered. Current access information is at https://xoxodrama.com/availability. Availability is subject to local content, age-assurance, privacy, language and consumer rules; an English policy does not authorize access everywhere. We may restrict or stop access where these requirements are not met. You must not disguise your location or bypass a restriction to access the Service from an unsupported location.

2.5 Protecting minors. You must not allow a minor to access the Service through your device, browser or account. If minors use your devices, use appropriate parental controls and content filters. Age confirmation and adult-content labels are safeguards; neither guarantees that minors cannot gain access.

2.6 If we learn or reasonably believe that a user does not meet the requirements of this Section 2, we may block access to the Service and close any related account.

3. Accounts

3.1 Optional accounts. You can watch Content without an account. If you wish, you can create an account by signing in with Google or with a one-time code sent to your email address. Creating an account or signing in is not a form of age verification and does not change the requirements in Section 2.

3.2 Your responsibilities. You must use an email address that you control and keep it up to date. You must keep your sign-in codes and devices secure, and you are responsible for activity under your account. Please tell us promptly at xoxodramaprivacy@proton.me if you believe your account has been used without your permission.

3.3 One adult per account. An account is for one adult only. You must not sell, transfer or share your account.

3.4 Deleting your account. You may request deletion at any time by emailing xoxodramaprivacy@proton.me with the subject “Account Deletion” from the address linked to your account. You do not need to sign in to make a request. We use proportionate checks before deleting information. Section 12 and our Privacy Policy explain the consequences and limited retention exceptions.

4. The Content

4.1 Nature of the Content. The Service offers short serialized video dramas and related images, text, subtitles and audio (the "Content"). The Content is sexually explicit and is intended solely for adult entertainment. It depicts nudity and sexual activity between fictional adult characters and may include strong language and mature dramatic themes. Tags and descriptions are provided for convenience and may not be complete.

4.2 AI-generated and fictional. Our team creates the Content using artificial intelligence tools and human editorial decisions. Characters are fictional adults and are not intended to represent a real, identifiable person. We do not accept sexual depictions of minors, persons who appear to be minors or unauthorized real-person likenesses. Content is subject to editorial review before publication. Report any suspected resemblance or violation under Section 9.

4.3 Content Standards. We produce and publish Content in accordance with our Content Standards. Among other things, they prohibit any depiction of minors or of persons who appear to be minors, any likeness of a real person, and any depiction of sexual violence or non-consensual sexual activity.

4.4 Fantasy, not advice. The Content is fantasy. It does not represent our views or real persons or events, and it is not a guide to real-life sexual behavior. In real life, sexual activity requires the free, informed and ongoing consent of everyone involved. You choose whether to view any Content.

4.5 Changes to Content. We may add, change or remove Content or features at any time without notice.

5. A Free Service

5.1 The Service is currently free of charge. We do not sell subscriptions or in-service purchases, and we do not display third-party advertising.

5.2 If we introduce paid features in the future, we will clearly show the price and the applicable terms before you are asked to pay. Those features will be subject to additional terms that you will need to accept at that time.

6. Your License and Restrictions

6.1 License. Subject to these Terms, we grant you a limited, personal, non-commercial, non-exclusive, non-transferable, non-sublicensable and revocable license to access the Service and stream the Content through a standard web browser.

6.2 Restrictions. You must not, and must not help anyone else to:

(a) download, record, screen-capture, copy, re-upload, distribute, sell, publicly perform or display any Content, except as expressly allowed by a feature of the Service;

(b) make any Content available to a minor, or to anyone in a location where we do not offer the Service;

(c) bypass, disable or interfere with our age confirmation, location restrictions, content protection, signed links or other technical measures;

(d) access the Service with bots, scrapers, crawlers or other automated means, except for search engine crawlers that follow our robots.txt file;

(e) use any Content or any part of the Service to train, fine-tune, test or improve any artificial intelligence or machine learning model, or to build any dataset;

(f) use any Content to create material that depicts a real person (including so-called "deepfakes") or that depicts, or appears to depict, a minor;

(g) embed or frame the Service or any Content on another website, or link directly to our media files;

(h) reverse engineer, decompile or try to extract the source code of the Service, except to the extent the law allows this despite this restriction;

(i) probe, scan or test the vulnerability of the Service without our written permission, or interfere with or overload the Service (you may report security issues to xoxodramaprivacy@proton.me);

(j) misuse our reporting, support or privacy request tools, including by submitting false, abusive or automated requests; or

(k) use the Service for any unlawful purpose or in breach of these Terms.

7. Feedback, Material You Send Us and Communications

7.1 Feedback. If you send us ideas or suggestions about the Service, we may use them without any obligation to you.

7.2 Material you send us. The Service does not currently allow comments or uploads. If you send us information through a report, support request or privacy request, you confirm that you are entitled to send it. We use it only to handle your request and as described in our Privacy Policy. Do not send us sexually explicit images of any real person. If you are reporting intimate images shared without consent, follow our Reporting and Removal Policy, which explains how to identify the material without sending it to us.

7.3 Electronic communications. We may send service messages, including sign-in codes, security alerts, replies to requests and notices about changes to these Terms. These are not consent to marketing. We do not send promotional campaigns at launch. If that changes, we will obtain any permission required by law and provide a way to unsubscribe.

8. Intellectual Property and Copyright Complaints

8.1 Rights in the Service. We own or license the software, editorial contributions, design, branding and other protected elements of the Service. Rights in particular AI-generated outputs depend on applicable law; we do not claim that every AI-generated element is independently copyrightable. Our rights are reserved to the extent they exist, and our contractual use restrictions remain subject to mandatory law.

8.2 Copyright complaints. If you believe that material on the Service infringes your copyright or other rights, please send a notice as described in our Copyright Policy at https://xoxodrama.com/copyright, or by email to dmcaxoxodrama@proton.me. Your notice should include: (a) your physical or electronic signature; (b) identification of the work you claim is infringed; (c) identification of the material on the Service, including its URL; (d) your name, address, telephone number and email address; (e) a statement that you have a good-faith belief that the use is not authorized by the rights owner, its agent or the law; and (f) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the rights owner or are authorized to act on the owner's behalf. A person who knowingly makes a material misrepresentation in a notice may be liable for damages.

9. Reporting Content

9.1 Anyone may report Content, without an account, through the instructions at https://xoxodrama.com/report or by emailing xoxodramaprivacy@proton.me with the subject “Content Report.” Include the exact URL and the reason for the report. Do not send us explicit images of a real person, identity documents or unnecessary sensitive material.

9.2 We prioritize suspected minor-related content, nonconsensual intimate imagery and unauthorized real-person likenesses. We aim to review urgent reports and take appropriate protective action within 48 hours of receiving enough information to locate the material. Where the TAKE IT DOWN Act applies, we remove content covered by a valid request as soon as possible and no later than 48 hours, and make reasonable efforts to identify and remove known identical copies. Other legal duties may require faster action. Our Reporting and Removal Policy explains the required information, outcomes and review process.

9.3 Authorities may send lawful requests to xoxodramaprivacy@proton.me with the subject “Law Enforcement” or “Regulatory Request.” We assess authority and legal basis before disclosure; sending a request does not create an entitlement to personal information.

10. Privacy

Our Privacy Policy explains how we collect, use and protect personal information and what rights you have. In short: we collect as little as we can, we do not keep a viewing history linked to your account, and we do not sell your personal information or use it for targeted advertising.

11. Third-Party Services

If you choose to sign in with Google, your use of Google's services is governed by Google's own terms and privacy policy. The Service may contain links to third-party websites. We are not responsible for third-party services or websites.

12. Suspension, Termination and Account Deletion

12.1 You may stop using the Service at any time and delete your account as described in Section 3.4.

12.2 We may suspend or end your access to the Service, or close your account, if you breach these Terms, if we reasonably believe you do not meet the requirements of Section 2, if the law requires us to do so, or if your use creates a risk for other people or for us. Where it is practical and lawful, we will tell you the reason.

12.3 We may stop offering the Service, or any part of it, in any location or entirely. Where practical, we will notify account holders at least 30 days in advance.

12.4 Sections 6.2, 7.1, 8, 13 to 15 and 17 continue to apply after these Terms end.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," FREE OF CHARGE AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ANY CONTENT WILL REMAIN AVAILABLE.

Nothing in these Terms excludes or limits any warranty, guarantee or right that cannot be excluded or limited under the law that applies to you, including the consumer protection laws of your state, province or country.

14. Limitation of Liability and Indemnity

14.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, LICENSORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS.

14.2 TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED US$100 (OR THE EQUIVALENT IN YOUR LOCAL CURRENCY).

14.3 Sections 14.1 and 14.2 do not limit our liability for death or personal injury caused by our negligence, for fraud, for gross negligence or willful misconduct, or for any other liability that cannot be limited under applicable law. If you are a consumer in Quebec, nothing in these Terms limits our liability for material injury caused by an intentional or gross fault, or your rights under the Quebec Consumer Protection Act.

14.4 Indemnity. To the extent permitted by law, you will compensate us for reasonable losses and costs (including reasonable legal fees) that arise from claims by third parties caused by your breach of these Terms or your misuse of the Content. This Section does not apply to you to the extent that the law of your place of residence does not allow it, including if you are a consumer in Quebec.

15. Governing Law and Disputes

15.1 Contact and complaints. You may contact xoxodramaprivacy@proton.me with the subject “Legal Notice” or use our Complaint Policy at https://xoxodrama.com/complaints. We will try to resolve concerns in good faith within 30 days. Contacting us first is not a prerequisite to an urgent remedy or to exercising a mandatory right.

15.2 Governing law. These Terms are governed by the laws of the Czech Republic, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the place where you live, including its consumer protection laws.

15.3 Courts and out-of-court remedies. Mandatory rules on jurisdiction and consumer remedies prevail. Consumers may bring proceedings in a court available to them under applicable law, including their home courts where those rules permit. We will bring a claim against a consumer only in a competent court permitted by those rules. No mandatory arbitration or class-action waiver is imposed by these Terms. Where competent for a consumer dispute, the Czech Trade Inspection Authority offers alternative dispute resolution; information is at https://coi.gov.cz/alternative-dispute-resolution-for-consumer-disputes-adr/.

15.4 Nothing in this Section prevents you from contacting a consumer protection or privacy authority.

16. Changes to These Terms

16.1 We may update these Terms from time to time. For a material change, we will give at least 30 days' notice before it takes effect, by email to account holders and by a notice on the Service. The notice will describe the change and the date it takes effect.

16.2 If you do not agree to a material change, you may stop using the Service and request account deletion before the change takes effect. Where the law requires fresh agreement, we obtain it; mere continued use is not treated as consent to unrelated personal-data processing.

16.3 Non-material clarifications and administrative updates may take effect when posted, except where applicable law requires otherwise. An availability update does not waive local rights. Changes do not retrospectively alter a dispute that has already arisen.

17. General

17.1 Entire agreement. These Terms, together with the documents referred to in Section 1.3, are the entire agreement between you and us about the Service.

17.2 Severability and waiver. If any provision of these Terms is found to be unenforceable, the remaining provisions remain in effect. If we do not enforce a provision, that is not a waiver of our right to do so later.

17.3 Assignment. You may not transfer your rights or obligations under these Terms. We may transfer ours in connection with a merger, acquisition, reorganization or sale of assets, or by operation of law, provided that your rights under these Terms are not reduced.

17.4 Events beyond our control. We are not responsible for delays or failures caused by events beyond our reasonable control.

17.5 Notices. We may send notices to the email address linked to your account or post them on the Service. You may send notices to us at xoxodramaprivacy@proton.me or by post to the address in Section 18.

17.6 Local protections. Mandatory consumer, privacy, content and language rights in your location remain available. Where a provision is restricted by those rules, it applies only to the extent permitted. You may contact the relevant consumer or privacy authority without first exhausting our complaint process.
